terms of service

1. What Crumb is

Crumb gives you a private place to save food-related memories.

You can photograph or select food, turn it into a playful sticker-like object, add context about the moment, and save it as a Crumb. Crumb may use automated and AI-assisted processing to reduce the effort required to create a memory.

Crumb is intentionally not:

  • a calorie tracker;
  • a nutrition or health service;
  • a restaurant review platform;
  • a medical or dietary advice service; or
  • a public social network.

2. Eligibility

You may use Crumb only if you are legally permitted to enter into these Terms and use the service under the laws that apply to you.

If you are below the age at which you can lawfully consent to the processing of personal information or enter into these Terms in your jurisdiction, you may use Crumb only with the involvement and authorization of a parent or legal guardian where permitted by law.

3. Your account

Some Crumb features require an authenticated account.

You are responsible for:

  • providing information that is accurate to the extent required for your account;
  • keeping access to your authentication method secure;
  • using your own account rather than another person's account; and
  • promptly contacting us if you believe your account has been accessed without authorization.

3. Your account — continued

Crumb may use platform authentication providers rather than requiring you to create a separate Crumb password.

You may sign out without deleting your account. Account deletion is a separate action and is intended to delete your account and associated user-owned Crumb data.

4. Your Crumbs and your content

You retain your rights in the photographs, writing, and other original content that you provide to Crumb, subject to the rights you grant to us below so that we can operate the service.

You are responsible for the content you put into Crumb and for making sure that you have the necessary rights and permissions to use it.

For example, you should not upload an image if doing so would unlawfully violate another person's privacy, copyright, trademark, publicity rights, or other rights.

5. Permission to operate the service

To provide Crumb, you give us a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, transform, and display your content solely as reasonably necessary to:

  • provide Crumb features you request;
  • store and display your Crumbs;
  • process photographs into the Crumb visual format;
  • perform requested automated or AI-assisted processing;
  • synchronize your account across supported devices;
  • secure, maintain, troubleshoot, and improve the service; and
  • comply with legal obligations.

5. Permission to operate the service — AI and machine learning

This license does not give us ownership of your memories or authorize us to publicly publish your private Crumbs.

We do not claim ownership of your food photographs or personal writing merely because you store them in Crumb.

Where you have separately authorized it, including through an explicit opt-in provided by the product, this license also permits us to use the content covered by that authorization to develop, train, fine-tune, evaluate, test, benchmark, and improve Crumb's machine-learning and AI systems. This may include systems for image segmentation and background removal, image transformation, food recognition, classification, and other Crumb features. We will use such content for these purposes only to the extent permitted by your authorization and applicable law. This does not transfer ownership of your content to us.

6. Private by default

Crumb is designed as a private product.

Crumb does not make your Crumbs public by default. Features such as public profiles, public feeds, followers, following, likes, comments, or public engagement rankings may not be available and may be introduced only if the product later provides them.

Your Crumbs are associated with your account and are not intended to be publicly searchable or visible to other users.

You are still responsible for protecting your own account access and for anything you voluntarily share outside Crumb.

7. Automated and AI-assisted features

Crumb uses automated and AI-assisted technology for parts of the product experience.

These systems may help with tasks such as:

  • identifying food;
  • generating a food title;
  • generating or assisting with a moment description;
  • classifying food; and
  • processing or transforming an image into a food sticker.

7. Automated and AI-assisted features — continued

Depending on the device, operating system, feature, and version of Crumb you use, some processing may occur directly on your device and some may be performed by Crumb's servers or by third-party service providers acting on Crumb's behalf.

AI-generated information can be wrong. Crumb does not guarantee that AI-generated food identification, descriptions, classifications, image processing, or other outputs are accurate.

AI output should not be treated as medical, nutritional, dietary, allergy, or other professional advice.

Where the product provides editing controls, you remain responsible for reviewing information before saving it.

8. Your responsibilities

You agree not to use Crumb to:

  • violate any applicable law or regulation;
  • infringe another person's intellectual-property, privacy, publicity, or other rights;
  • upload content that you do not have the right to use;
  • impersonate another person or misrepresent your identity;
  • attempt to access another user's account or data;
  • probe, scan, or test Crumb's systems for vulnerabilities without authorization;
  • bypass authentication, access controls, rate limits, or other security mechanisms;
  • interfere with or disrupt the service;
  • introduce malware, malicious code, or harmful material;
  • reverse engineer or decompile Crumb except to the extent that applicable law expressly permits it;
  • scrape, harvest, or systematically extract private Crumb data;
  • use automated systems to abuse the service or create unreasonable load; or
  • use Crumb to create a competing service by systematically copying protected materials or private data.

8. Your responsibilities — continued

These restrictions do not prohibit lawful activities that applicable law expressly protects.

9. Acceptable content

You may save personal memories, food photographs, descriptions, locations, and other content that is appropriate for a private food-memory journal.

You must not use Crumb to store or distribute content that is unlawful or that you do not have the right to possess or use.

Because Crumb is private, we do not proactively review every user's memory content. We may investigate content or activity when necessary to address security issues, abuse, legal obligations, or credible reports of violations.

10. Location and third-party processing

Some Crumb features may use third-party services for authentication, location search, image processing, AI-assisted processing, storage, notifications, or other infrastructure needed to provide the service.

Depending on the platform and feature, image processing may occur locally on your device or through Crumb's servers or a third-party service provider acting on our behalf. The processing method and providers may change as Crumb evolves.

When you use a feature that requires one of these services, information necessary to perform that feature may be processed by the applicable provider.

Crumb may change, replace, or add service providers where reasonably necessary to operate, improve, secure, or expand the service.

Your use of third-party authentication, app-store, operating-system, or other platform services may also be subject to the terms and policies of those providers.

11. Intellectual property in Crumb

The Crumb name, brand, visual identity, software, interface, design, illustrations, text created by Crumb, and other original materials provided by Crumb are owned by or licensed to Crumb and are protected by applicable intellectual-property laws.

Except as expressly permitted by these Terms or applicable law, you may not copy, modify, distribute, sell, lease, reverse engineer, publicly display, or create derivative works from Crumb's proprietary materials.

Nothing in these Terms prevents you from exercising rights that applicable law gives you over your own content.

12. Feedback

If you send us suggestions, ideas, bug reports, or other feedback, you allow us to use that feedback without restriction or compensation, including to improve, develop, and promote Crumb.

We do not acquire ownership of your private Crumb memories through ordinary feedback.

13. Availability and changes to the service

We are building Crumb as a small product and the service may change over time.

We may:

  • add, modify, or remove features;
  • change technical implementations or service providers;
  • temporarily suspend features for maintenance or security reasons; or
  • discontinue the service where reasonably necessary.

13. Availability and changes to the service — continued

We do not guarantee that Crumb will always be available, uninterrupted, secure, or error-free.

We will make reasonable efforts to keep the service functioning and to handle user data in accordance with our Privacy Policy and applicable law.

14. Deleting your account

You may delete your Crumb account using the account controls provided by the product.

Deleting your account is intended to remove your account and associated user-owned Crumb data and media. Some limited information may remain for a reasonable period where necessary for security, fraud prevention, legal compliance, dispute resolution, or technical recovery, including information contained in backups until those backups are naturally overwritten.

Account deletion is different from signing out. Signing out does not delete your data.

15. Suspension and termination

We may suspend or terminate your access to Crumb if we reasonably believe that:

  • you have materially violated these Terms;
  • your use creates a security, operational, or other material risk to Crumb, our users, or the service;
  • your use is unlawful;
  • your account is being used for abuse or fraud; or
  • suspension or termination is necessary to comply with a legal obligation.

15. Suspension and termination — continued

Where reasonably possible, we will take proportionate action and provide notice or an opportunity to address the issue. We may suspend or terminate access without prior notice where we reasonably believe immediate action is necessary for security, abuse prevention, fraud prevention, legal compliance, or to protect Crumb, our users, or the service.

You may stop using Crumb at any time.

Sections that by their nature should survive termination, including intellectual property, disclaimers, limitations of liability, dispute provisions, and applicable law, will continue to apply after termination.

16. Disclaimers

To the maximum extent permitted by applicable law, Crumb is provided on an "as is" and "as available" basis.

We do not guarantee that:

  • the service will meet every particular requirement;
  • the service will always be available or uninterrupted;
  • generated content will be accurate or complete;
  • food identification will always be correct;
  • image processing will always produce the desired result;
  • locations returned by third-party services will always be accurate; or
  • the service will be free of every bug, vulnerability, or error.

16. Disclaimers — continued

Crumb is a memory product, not a health, nutrition, allergy, medical, or professional-advice service. Do not rely on AI-generated food information for decisions where an incorrect result could cause harm.

Nothing in these Terms excludes a warranty, right, or remedy that cannot lawfully be excluded.

17. Limitation of liability

To the maximum extent permitted by applicable law, Crumb and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, or data, arising from or related to your use of the service.

To the maximum extent permitted by applicable law, the total liability of Crumb and its operator for claims arising from or relating to the service will be limited to the greater of:

  • the amount you paid to Crumb for the service during the twelve months before the event giving rise to the claim; or
  • USD 100.

17. Limitation of liability — continued

This limitation does not apply where liability cannot lawfully be limited or excluded, including liability that applicable law prohibits us from limiting.

18. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Crumb and its operator from claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful use of the service, your violation of these Terms, or your infringement of another person's rights.

This section does not apply to the extent that a claim results from Crumb's own unlawful conduct or from rights that cannot legally be shifted to you.

19. Third-party platforms

Crumb may be distributed through third-party platforms, including Apple's App Store and, where available, Google Play. Those platforms may have their own terms, policies, and requirements.

Your use of Crumb may also be subject to those platform terms where applicable.

Third-party services integrated into Crumb are not controlled by Crumb, and their own terms and policies may apply to your interaction with them.

20. Privacy

Your privacy is important to us. Our handling of personal information is described in the Privacy Policy.

The Privacy Policy explains what information Crumb collects, why we use it, the providers that may process it, retention and deletion, and applicable privacy rights.

21. Governing law and disputes

These Terms are governed by the laws applicable to the jurisdiction in which the operator of Crumb is established, without regard to conflict-of-law principles, except where mandatory consumer-protection or other applicable law requires otherwise.

Before starting a formal legal proceeding, we encourage you to contact us at pingcrumb@gmail.com and give us a reasonable opportunity to resolve the issue informally.

Nothing in this section prevents you from exercising a right to bring a complaint before a regulator, court, or other authority where applicable law gives you that right.

22. Changes to these Terms

We may update these Terms when Crumb changes, when new features are introduced, or when legal requirements change.

If we make a material change, we will update the "Last updated" date and, where appropriate, provide additional notice through the app or website.

Your continued use of Crumb after an updated version becomes effective means that you accept the updated Terms to the extent permitted by applicable law.
